09. Maternity Rights and Educational Support (Mutterschutz und Erziehungshilfen)

1.   Child Benefit and Supplementary Allowances (Kindergeld und Kinderzuschlag)
 
As a rule, all parents are entitled to receive Child Benefit for those of their children who are living in Germany (There may be exceptions for the nationals of certain countries who have no right of permanent residence in Gemany). Child Benefit is granted for all children from birth to the age of 18. Under certain circumstances, Child Benefit may continue to be paid thereafter. Application and processing is undertaken by the Familienkasse of the Bundesagentur for Arbeit. You can find more information and application forms on the Internet under www.familienkasse.de. Child Benefit is paid monthly. Child Benefit for both the first and second child is 192 €, 198 € for the third child and 223 € for each additional child.

Der Kinderzuschlag bietet Familien mit kleinem Einkommen eine finanzielle Unterstützung. Um ihn zu erhalten, müssen diese Voraussetzungen erfüllt sein:

  • Sie erhalten Kindergeld (oder eine vergleichbare Leistung) für das Kind.
  • Ihr Bruttoeinkommen beträgt mindestens 900 Euro (Elternpaare) oder 600 Euro (Alleinerziehende).
  • Ihr Bruttoeinkommen übersteigt nicht die Höchsteinkommensgrenze.
  • Zusammen mit dem Kinderzuschlag haben Sie so viel Einkommen, dass Sie keinen Anspruch auf Arbeitslosengeld II oder Sozialgeld haben.

Der höchstmögliche Kinderzuschlag beträgt für jedes im gemeinsamen Haushalt lebende Kind 160 Euro monatlich.

2.   Parental Benefit (Elterngeld)
 
Parents are entitled to Parental Benefit (Elterngeld) who:

  • Have a permanent residence (festen Wohnsitz) in Germany und Ausländer eine Aufenthaltserlaubnis besitzen, die zur Ausübung einer Erwerbstätigkeit berechtigt,
  • After the birth themselves care for and raise their child;
  • Live in the same household as their child;
  • Do not work for an average of more than 30 hours a week.

Parental Benefit (Elterngeld) replaces 65 - 67% of the previous net wage/salary (depending on the amount of the previous income) of the parent staying at home with the child up to a maximum of 1,800 € per month. For low earners with an income of less than 1,000 € per month before the birth of the child, the Parental Leave Benefit  goes up to 100 % in stages. Parents who are not working receive at least 300 € a month.

Parental Leave Benefit is paid for 12 months following the birth. If both parents are involved in raising the child, you may receive Parental Leave Benefit for a maximum of 14 months. Single parents may claim for the entire 14 months.

Parental Leave Benefit will, as a rule, be treated as income for the purpose of Unemployment Benefit II, Social Security Benefits and supplementary Child Benefit.

The entitlement to Parental Leave Benefit lapses with a total annual taxable income of more than 500,000 € for both parents and and 250,000 € for single parents.  3.   Maternity Rights (Mutterschutz)
 
Pregnant women are entitled to special protection, but subject to time limits, both during and after pregnancy. As soon as she knows that she is pregnant and knows the due date, as an employee she is obligated to notify her employer. While continuing to work, pregnant women may not undertake health endangering activities. Maternity Rights time lmits serve to ensure their rest and safety before the birth, so as to be able to dedicate themselves to the child after the birth. Maternity Rights begin 6 weeks before the birth. During this period, pregnant women only need to work if they expressly wish to do so. But for 8 weeks after the birth, there is a complete ban on work. During this period, the employer will pay Maternity Benefit, whereby he may receive an employers‘ supplement (Arbeitgeberzuschuss) from the responsible health fund.

 

4.   Parental Leave (Elternzeit)
 
Employees who care for and raise their children themselves are entitled to Parental Leave until the child reaches the age of three. With the consent of the employer, you may postpone up to twelve months of the Parental Leave to the period between the child’s third and eighth birthday.
Working parents are free to decide which of them will take Parental Leave. Whoever takes Parental Leave can work part-time for up to 30 hours a week.
There is protection against dismissal (Kündigungsschutz) during Parental Leave.

5. Maintenance Allowance (Unterhaltsvorschuss)
 
A parent may receive a Maintenance Allowance from the Youth Office (Jugendamt) in the Adminstrative District offices if the child:  

Is resident or ordinarily resident in the Schwäbisch Hall Administrative District;

  • Lives with a single parent;
  • Is not, or only partially or not regularly maintained by the other parent;
  • Is not yet 12 years old.

 
The Maintenance Allowance will be paid for a maximum of 72 months.
